UL warns of fibre optic volcano lamp with counterfeit UL Marks

Underwriters Laboratories Inc. is notifying consumers that the Fibre Optic Volcano lamp identified below has not been evaluated for safety by UL. This product bears a counterfeit UL Mark for the United States and Canada.

On the Product: The lamp has a label on the bottom of the base. The label contains a counterfeit UL Listing Mark and the following description:

LISTED
PORTABLE
LAMP
6G22
MADE IN CHINA

On the Packaging: The packaging is marked with counterfeit UL Listing Marks and the following description of the product:

GLITTER
FIBRE OPTIC
VOLCANO
MADE IN CHINA

What you should do: UL recommends that users stop using the product immediately and return it to the place of purchase.

Silly question, but is it illegal to falsify the UL mark?

And if a product has a counterfeit mark is it illegal to sell? And if it is illegal to sell, then is the importer or retailer liable for any possible damages?

I'm going to give you the best seat of the pants and wild ass guess answer I can to those questions.
I do know it is illegal to use that listing mark without approval. So the actual placement of the label would be illegal.
I have no idea if the retailer or importer would be held liable for a product they felt was legal to import/sell.

Now on to the next part. Is it safe to USE that product? You'd never see me with one if I knew it.
