  1. Texas has been the main pipeline for illegal immigrants to cross into the USA.

  6. January 24th the Supreme Court ruled that the Federal Government could go in and remove the razor wire barrier that Texas installed.
  7. January 24th the State of Texas said it would not comply, claimed that the Federal Government has broken its compact with the states and failed its obligations
  8. At least 24 other states have publicly issued statements in support of Texas and their efforts to close their border
  9. January 25th President Biden issued an ultimatum to Texas telling Texas to stand down, allow the US federal government to remove the barriers erected by Texas on January 26th, or "face the consequences"


I'm not quite sure how the media will spin this, but it seems like a future campaign issue that will kill support for Biden?

 
This is not the first time Texas and the Federal government have come to loggerheads. There has a presumption that Texas entered the Union as a free nation and can leave anytime it wants. How true this is I, along with many, don't really know. It hasn't been tested.

I do remember, under Obama, a close friend high up in the Texas government, promised me a "get out of town " call to Texas if such an act was about to be proclaimed. I believed him.

Texas does have the physical ability to close its borders and become physically independent of the USA with Electric power grid and petrol fuel isolation from the states. It also has plenty of seaports. And a few good Ole boys willing to defend their intentions.

Someone should tell His Excellency in the Whitehouse that the term,,,,;"Don't mess with Texas" is not a casual cliché"

Ilived in Texas in the mid 80"s for a couple years. If they succeed I will be moving back.

This could get interesting. The Texas Secessionist Movement is not insignificant and they are fighting to have the matter put on the ballot this spring. The fact that Biden is willing to take a heavy-handed approach to resolve the situation will piss off a whole bunch of people down here.

By-the-way, I read a long time ago that it is not actually legal for Texas to unilaterally secede from the Union but these days the legality of a situation or not doesn't seem to matter all that much.
 
As of now 26 states (including Texas) are opposed to Biden's ultimatum.

Oklahoma is ready to actually send National Guardsmen to the Texas border in support of Texans right to protect themselves from an "invasion" of illegal migrants.

Gov. Kevin Stitt (R-OK) declared his support for Texas “to defend our country against invasion.”
Stitt appeared on Fox and Friends Friday to respond to the call from former President Donald Trump suggesting states send their National Guard to the Texas border amid a surge in illegal crossings. The Oklahoma governor is one of 25 Republican governorswho have approved of Gov. Greg Abbott’s (R-TX) defensive actions at the border so far. Fox News anchor Steve Doocy asked Stitt if he plans to send National Guardsmen to Texas, to which he replied, “Absolutely.”
“This is just common sense. In Texas, there’s 28 ports of entry and it’s already a federal law that it’s illegal to enter anywhere but those points of entry,” Stitt said. “And so the fact that the federal government, Biden, is cutting the razor wire, it just makes no sense at all. So, yes, we have the right to defend our country against invasion. And what else would you call it if you’ve got 6 million people coming through illegally?”
During his time in office, Stitt sent the Oklahoma National Guard to Texas once before. Last July, a Virginia National Guard unit joined Operation Lone Star to help secure the southern border . . .
 
And it appears that Texas may NOT be in violation of any Supreme Court ruling by actually installing more razor wire. The court did not rule against Texas or say that Texas must stop installing razor wire. There are legal experts on both sides, and some who say Texas may not be technically in violation of the Supreme Court but it might still be wrong. Lots of ambiguity. So no doubt at this whole issue winds its way through the courts we will see some interesting discussions.

The high court’s temporary order allows the Department of Homeland Security to continue removing the wire, which federal officials argued “made it harder for front-line personnel to do their jobs and to apply consequences under the law,” according to the agency’s Monday evening statement.

Monday’s ruling does not end the dispute. It simply means that while the case moves forward, the injunction that the U.S. Court of Appeals for the 5th Circuit entered in December, which blocked federal officials from removing the razor wire, will remain on hold.

“The Supreme Court didn’t order Texas to do something or order Texas not to do something, so really there’s no Supreme Court orders being ignored,” South Texas College of Law professor Josh Blackman told the Washington Examiner.

“What’s going to happen now is lower courts will have to figure out exactly what Texas can and cannot do,” Blackman added.

Steve Vladeck, a law professor at the University of Texas School of Law, agreed that the Supreme Court issued no order against Texas for the governor to defy.
“It also, I think, testifies to how little those politicians understand what this case is actually about, because the actual ruling the Supreme Court handed down on Monday doesn’t require Governor Abbott to do anything,” Vladeck told the Texas Standard, saying the order merely “clears away the possible legal consequences” if Border Patrol agents continue to remove the wire.

While there’s ample agreement on this matter among experts, Case Western Reserve University law professor Jonathan Entin told the Washington Examiner that Abbott’s response is still walking a thin legal line.
Entin said Abbott and Paxton, both being lawyers, “should know better” than to try to reinstall the border wire, given that the order provides federal Border Patrol officers authority to remove it, calling it “irresponsible.” . . .

So, essentially President Biden can legally use the guard to enforce his illegal open border policy.

Past Presidents have Federalized the National Guard to ENFORCE NATIONAL LAWS but in this case Biden would literally be using the National Guard to IGNORE NATIONAL LAWS and that is an entirely different legal matter.

THE PRESIDENT: My fellow Americans, tonight, I’d like to talk with you about immigration.

For more than 200 years, our tradition of welcoming immigrants from around the world has given us a tremendous advantage over other nations. It’s kept us youthful, dynamic, and entrepreneurial. It has shaped our character as a people with limitless possibilities –- people not trapped by our past, but able to remake ourselves as we choose.

But today, our immigration system is broken -- and everybody knows it.

Families who enter our country the right way and play by the rules watch others flout the rules. Business owners who offer their workers good wages and benefits see the competition exploit undocumented immigrants by paying them far less. All of us take offense to anyone who reaps the rewards of living in America without taking on the responsibilities of living in America. And undocumented immigrants who desperately want to embrace those responsibilities see little option but to remain in the shadows, or risk their families being torn apart.

It’s been this way for decades. And for decades, we haven’t done much about it.

When I took office, I committed to fixing this broken immigration system. And I began by doing what I could to secure our borders. Today, we have more agents and technology deployed to secure our southern border than at any time in our history. And over the past six years, illegal border crossings have been cut by more than half. Although this summer, there was a brief spike in unaccompanied children being apprehended at our border, the number of such children is now actually lower than it’s been in nearly two years. Overall, the number of people trying to cross our border illegally is at its lowest level since the 1970s. Those are the facts.

Meanwhile, I worked with Congress on a comprehensive fix, and last year, 68 Democrats, Republicans, and independents came together to pass a bipartisan bill in the Senate. It wasn’t perfect. It was a compromise. But it reflected common sense. It would have doubled the number of border patrol agents while giving undocumented immigrants a pathway to citizenship if they paid a fine, started paying their taxes, and went to the back of the line. And independent experts said that it would help grow our economy and shrink our deficits.

Had the House of Representatives allowed that kind of bill a simple yes-or-no vote, it would have passed with support from both parties, and today it would be the law. But for a year and a half now, Republican leaders in the House have refused to allow that simple vote.

Now, I continue to believe that the best way to solve this problem is by working together to pass that kind of common sense law. But until that happens, there are actions I have the legal authority to take as President –- the same kinds of actions taken by Democratic and Republican presidents before me -– that will help make our immigration system more fair and more just.

Tonight, I am announcing those actions.

First, we’ll build on our progress at the border with additional resources for our law enforcement personnel so that they can stem the flow of illegal crossings, and speed the return of those who do cross over.

Second, I’ll make it easier and faster for high-skilled immigrants, graduates, and entrepreneurs to stay and contribute to our economy, as so many business leaders have proposed.

Third, we’ll take steps to deal responsibly with the millions of undocumented immigrants who already live in our country.

I want to say more about this third issue, because it generates the most passion and controversy. Even as we are a nation of immigrants, we’re also a nation of laws. Undocumented workers broke our immigration laws, and I believe that they must be held accountable -– especially those who may be dangerous. That’s why, over the past six years, deportations of criminals are up 80 percent. And that’s why we’re going to keep focusing enforcement resources on actual threats to our security. Felons, not families. Criminals, not children. Gang members, not a mom who’s working hard to provide for her kids. We’ll prioritize, just like law enforcement does every day.

But even as we focus on deporting criminals, the fact is, millions of immigrants in every state, of every race and nationality still live here illegally. And let’s be honest -– tracking down, rounding up, and deporting millions of people isn’t realistic. Anyone who suggests otherwise isn’t being straight with you. It’s also not who we are as Americans. After all, most of these immigrants have been here a long time. They work hard, often in tough, low-paying jobs. They support their families. They worship at our churches. Many of their kids are American-born or spent most of their lives here, and their hopes, dreams, and patriotism are just like ours. As my predecessor, President Bush, once put it: “They are a part of American life.”

Now here’s the thing: We expect people who live in this country to play by the rules. We expect that those who cut the line will not be unfairly rewarded. So we’re going to offer the following deal: If you’ve been in America for more than five years; if you have children who are American citizens or legal residents; if you register, pass a criminal background check, and you’re willing to pay your fair share of taxes -- you’ll be able to apply to stay in this country temporarily without fear of deportation. You can come out of the shadows and get right with the law. That’s what this deal is.

Now, let’s be clear about what it isn’t. This deal does not apply to anyone who has come to this country recently. It does not apply to anyone who might come to America illegally in the future. It does not grant citizenship, or the right to stay here permanently, or offer the same benefits that citizens receive -– only Congress can do that. All we’re saying is we’re not going to deport you.

I know some of the critics of this action call it amnesty. Well, it’s not. Amnesty is the immigration system we have today -– millions of people who live here without paying their taxes or playing by the rules while politicians use the issue to scare people and whip up votes at election time.

That’s the real amnesty –- leaving this broken system the way it is. Mass amnesty would be unfair. Mass deportation would be both impossible and contrary to our character. What I’m describing is accountability –- a common-sense, middle-ground approach: If you meet the criteria, you can come out of the shadows and get right with the law. If you’re a criminal, you’ll be deported. If you plan to enter the U.S. illegally, your chances of getting caught and sent back just went up.

The actions I’m taking are not only lawful, they’re the kinds of actions taken by every single Republican President and every single Democratic President for the past half century. And to those members of Congress who question my authority to make our immigration system work better, or question the wisdom of me acting where Congress has failed, I have one answer: Pass a bill.

I want to work with both parties to pass a more permanent legislative solution. And the day I sign that bill into law, the actions I take will no longer be necessary. Meanwhile, don’t let a disagreement over a single issue be a dealbreaker on every issue. That’s not how our democracy works, and Congress certainly shouldn’t shut down our government again just because we disagree on this. Americans are tired of gridlock. What our country needs from us right now is a common purpose –- a higher purpose.

Most Americans support the types of reforms I’ve talked about tonight. But I understand the disagreements held by many of you at home. Millions of us, myself included, go back generations in this country, with ancestors who put in the painstaking work to become citizens. So we don’t like the notion that anyone might get a free pass to American citizenship.

I know some worry immigration will change the very fabric of who we are, or take our jobs, or stick it to middle-class families at a time when they already feel like they’ve gotten the raw deal for over a decade. I hear these concerns. But that’s not what these steps would do. Our history and the facts show that immigrants are a net plus for our economy and our society. And I believe it’s important that all of us have this debate without impugning each other’s character.

Because for all the back and forth of Washington, we have to remember that this debate is about something bigger. It’s about who we are as a country, and who we want to be for future generations.

Are we a nation that tolerates the hypocrisy of a system where workers who pick our fruit and make our beds never have a chance to get right with the law? Or are we a nation that gives them a chance to make amends, take responsibility, and give their kids a better future?

Are we a nation that accepts the cruelty of ripping children from their parents’ arms? Or are we a nation that values families, and works together to keep them together?

Are we a nation that educates the world’s best and brightest in our universities, only to send them home to create businesses in countries that compete against us? Or are we a nation that encourages them to stay and create jobs here, create businesses here, create industries right here in America?

That’s what this debate is all about. We need more than politics as usual when it comes to immigration. We need reasoned, thoughtful, compassionate debate that focuses on our hopes, not our fears. I know the politics of this issue are tough. But let me tell you why I have come to feel so strongly about it.

Over the past few years, I have seen the determination of immigrant fathers who worked two or three jobs without taking a dime from the government, and at risk any moment of losing it all, just to build a better life for their kids. I’ve seen the heartbreak and anxiety of children whose mothers might be taken away from them just because they didn’t have the right papers. I’ve seen the courage of students who, except for the circumstances of their birth, are as American as Malia or Sasha; students who bravely come out as undocumented in hopes they could make a difference in the country they love.

These people –- our neighbors, our classmates, our friends –- they did not come here in search of a free ride or an easy life. They came to work, and study, and serve in our military, and above all, contribute to America’s success.

Texas Defies Joe Biden By Recruiting Volunteers To Bolster Border Fight

Texas has continued to defy President Joe Biden on the border issue and is offering cash for Texas Military Department members to man the border.​
The Lone Star State is seeking "to deploy border security assets to high threat areas to deny criminal organizations the ability to illegally move drugs and people into Texas," according to TMD's website.​
This comes amid ongoing tensions between Governor Greg Abbott and the Biden administration over the border with Mexico. On Monday, the Supreme Court sided with the Biden administration and held that federal Border Patrol agents were authorized to remove the razor wire installed under Abbott's orders near the border city of Eagle Pass.​
Volunteers will work with the Texas Military Department full-time for up to $55 per day, according to the agency's website.​

He lied when he spoke it in public.

Obama has always been in favor of open borders.

Obama believes that packing the USA with poor people helps insure a long future of future Democratic voters.

Look to other politicians, Senator John Tester is in a tough race to keep his senate seat, he represents a NORTHERN border state, in entire career he has never favored border security. That is until now. A couple decades of inaction and now, all of a sudden, he changes his tune. Same as Obama. Same as Biden.

Hell it was just a few weeks ago that Biden said the border is secure. Biden never admitted there is a border crisis.

Look at the liberal media, there are ZERO reports of a border crisis prior to the last couple of weeks. They simply ignored the story and didn't report on it. The liberal media only reports on the migrants flooding into Chicago and New York and Denver because those are sanctuary cities and they want Texas to keep all of the migrants.

The SCOTUS said the border patrol could legally remove wire. It would seem they haven't.

According to the news I have seen and read, the border agents have not removed any wire. In fact, they support the efforts of Texas to assist them in doing their duty.

Florida, Kentucky, Georgia, South Carolina and Nebraska are sending EITHER National Guard or State Troopers, but are not sure which will go from each of those states. I'd rather see 50-100 state troopers that can NOT be federalized sent versus 500 National Guard troops who can be, at Biden's order, federalized.

The troopers and volunteers are not able to be forced to follow Biden. The National Guardsmen who, if they are federalized, would face court marshal and serious discipline if they don't follow Biden's orders. I'd hate to the the N.G. face criminal penalties for doing the right thing and defying orders from Biden.

My daughter lives in one of those sanctuary cities.

My home is (sadly) within 60 miles of one of those sanctuary cities.

But they are getting exactly what they invited.

And they want the states/cities that DID NOT invite these people to harbor the costs and harbor the people that the sanctuary cities literally invited into the country. A sign in the yard of a Yuppie or former Hippie that says "Nobody is Illegal" does not mean much when the illegal knocks on their door asking for help. Those same people dial 911 and have the unwashed masses whisked away to some poor neighborhood where the poor are revolting against losing their schools, losing affordable housing, losing benefits, and generally getting kicked in the head.

I am comfortably RURAL enough. No mass transit to get illegals to me. No charity organization is dropping them on my town's doorstep. But I worry for our daughter.

FWIW, the SCOTUS ruling was VERY LIMITED.
It did NOT forbid Texas from putting up razor wire.
It did NOT say Texas can't protect itself.
It did NOT say that Texas has to allow federal officials to have access to the border.

It DID say that the federal officials can take out the razor wire. That is all. Nothing more.

The SCOTUS ruling, so far, is harmless. It simply tells the Border agents they can legally cut the wire.

They do not want to cut the wire.

What is happening now is that more wire is being set by Texas, with assistance from other states.

We may have a border wall, at least in Texas, before Trump gets a chance to build one.

Border Patrol Says Agents Will Not Remove Texas Razor Wire Barriers

In defiance of the Biden Administration’s wishes, senior figures within Customs and Border Protection have stated that there are no plans to have Border Patrol agents remove razor wire barriers erected along sections of the border by the Texas National Guard.
Fox News reports that a high ranking CBP official told the network that their relationship with the Guard is “strong”.
“While this issue plays out in the courts, the relationship between Border Patrol, Texas DPS [Department of Public Safety], & TMD [Texas Military Dept.] remains strong,” the official said, adding “Our focus is and will always be the mission of protecting this country and its people.”
“On the ground, we continue to work alongside these valuable partners in that endeavor,” the official continued, adding “Bottom line: Border Patrol has no plans to remove infrastructure (c-wire) placed by Texas along the border.”
“Our posture remains the same. If we need to access an area for emergency response, we will do so. When that happens, we will coordinate with Texas DPS & TMD,” the official further declared.
The Border Patrol Union also issued a statement outlining that agents will not interfere with Texas National Guard members carrying out “lawful” operations.
“TX NG and rank-and-file BP agents work together and respect each other’s jobs. Period. If TX NG members have LAWFUL orders, then they have to carry out those orders,” the statement notes.

FWIW, the SCOTUS ruling was VERY LIMITED.
It did NOT forbid Texas from putting up razor wire.
It did NOT say Texas can't protect itself.
It did NOT say that Texas has to allow federal officials to have access to the border.

It DID say that the federal officials can take out the razor wire. That is all. Nothing more.

Exactly as I understand it.
 
All I'm saying is this could be a catalyst that could lead to shooting at each other. Im as conservative as they come, I'm not supporting the federal governments actions on the border. Just saying , when you have half the states committing to send there national guard to help Texas and the feds threatening to federalize the national guard. What could go wrong?
