The Judge in the Daniel Penny case has dismissed the manslaughter charge. The jury will continue deliberating Monday on the lesser charge of criminally negligent homicide.

The judge should have dismissed this case when it was brought to court. Now they want to charge him with a different crime instead of dismissing the case.

Every member of this jury like rides the Subway once in a while. A guilty verdict will tell every New Yorker, they are not safe to ride the trains. They should have decided within the first hour of the first day. IMHO This trial is political and shouldn't be happening at all.

The jury is hung on the manslaughter charge. And cannot come to a verdict on the lesser charge.
So,
Alan Bragg stepped in, spoke to the judge.
The judge dismissed the Manslaughter and told them to concentrate on a lessor charges.
Is this even legal?

These twelve citizens should tell AG Bragg and the PA to stuff it. But; They won't.

This trial should have been over with a not guilty verdict in five minutes. Not five days with a continuance.
I never want New Yorkers as my neighbors.
 
The fact seems to be obvious. That AG Bragg wants a conviction no matter how they must twist the law and justice to get it.

The question is why?
Because Danial Penny is a Marine?
Because he is white?
Because he is not a pussy but a real man capable, and willing, of defending himself and his fellow citizens?

Bragg is tired of losing, this is not the case to save face but he is stupid! Maybe be vigilant on a murdering illegal?
 
The sad reality is that Penny should not even be in this situation. He should be receiving an award, not being tried. But now that he is in this situation, the jurors feel they must diligently weigh the law against Penny's actions. Common sense tells you that what Penny was only trying to do what was right, but the law is not always in line with common sense.

If he's found guilty of anything, it will set a bad precedent. It will make life even more dangerous for people, because would-be good Samaritans will be more reluctant to step in. Just the fact that Penny is on trial has no doubt made made people more reluctant to get involved, when everything good and decent would say otherwise.

However, if Penny is exonerated, the world becomes a little safer. It's clear what is the right thing to do.

This was the right decision by the jury.

Here's the message it sends to every able-bodied, law-abiding citizen: If you find yourself in a situation where you can help stop a bad actor who is threatening innocent people, help them. Do something. Intervene. Because the only thing necessary for the triumph of evil is that good men do nothing.

And here's the message to those would-be bad actors: Don't try it, because we Americans aren't going to stand by and do nothing. We're going to stop you. We're not taking your shit.

Our country just became a better place in which to live.

It's a hell of a good day to be an American.

I have a good idea. If Neely's parents sue Penny, all of the people on the subway that day that Neely threatened should sue Neely's parents in response. Their son threatened them and had to be restrained, and then died. Their son had mental problems, was on drugs, and decided he had nothing to lose. Where were his parents then? I mean, if they cared so much about him, they should have helped him. But they didn't, and that made him desperate. They are at fault.
