Ok My daughter just sold her car that was for sale for 800.00 A friend gave her 100.00 dollars down. She signed the title over. He drove off with it. We had a big fight! I told her that IS NOT HOW CARS ARE SOLD!! She said she trusts him to pay. I told her - when she purchased her first car,, she had to PAY FOR it! Not give some money down. Now she is furious with me!! And I don't care! The car in question cost her 700.00 and we put in over a years time 1,000.00 in repairs. It's a case of AS IS!! Now when she purchased the car for 700.00. She was faced with 400.00 in brake work a short time later. If she had only put 100.00 down.. what are the chances she would feel she only owes 200.00?
That is why cars are sold with FULL PAYMENT received before you sign the title.

Damn.. I'm pissed off. I told her that if she don't get paid the rest of the money - don't come crying to me. She said: "it's a freind I trust him."

So what I'm saying is that in 1,000 miles the car may be history. May need 500.00 im more repairs. The buyer may just say fuck it! I made a bad decision - and quit paying.

That is why you pay for it FIRST! Before driving it away. That is how cars are sold damn it!~

Bummer Tom , Title being signed over dont mean shit either if he gets in a wreck or runs into someone . she,s still liable no matter what until the title is transfered over through the state .

I been there done that with 2 different stepsons & I gavem them the damn car . first thing that happened in one of the boys cases the guy he sold it to hit 2 parked cars with him not even insuring it yet . I had to foot the bill & my luck it was a Mercedes & a Jaguar parked in front of the same residence & both were totalled . Dont even ask what that cost . Forget what he owes & make damn sure its insured . Just friendlly advice .

If he only had 100 bucks he sure as hell aint got enough for tags & insurance . I wish you both the best of luck . but rule #1 is never ever sell something to friends or familly , their the first ones to screw you , IMO :unsure:

Oh chit Bob!! Never thought about that! The idiot "friend" that bought it is a dope smoker that works at McDonalds. More the reason I'm furious! OH well - she is 18 now.. and is gonna find out the hard way.

18 or not , if something happens & She cant pay for it I,m afraid it might be on the parents shoulders . I could be wrong but if she,s living with You I beleive You could be held resposable . I,d do some checking to make sure . But thats a perfectlly good reason for You to be pissed & She should understand that if She knows what could happen . I sure hope it works out Tom . :smile:

If it was me I would report it stolen and let the cops make sure he has insurance or takes it off the road. Did she have enough sense to pull her tag?

Yes Sir! About 3 weeks ago she got a new car.. and took the tags off, and put them on her new car.
Transfered insurance too.
Does that help any?

Sure hope that the Guy you talked to aint blowing smoke up your butt , I,ve never once known an LEO give advice or make those kinds of claims over the phone .

Further more I You or her decided to report it stolen , you have two problems since she sighned the title & made an agreement . One being filing a false police report , the other being a charge of false imprisinment if he was picked up & detained because of the call .

Makes no sence that she,s not liable just because she transfered her tags & signed the title . Its not legally out of her name or control untill the title is transfered into his name & registered , normally involving both parties being involved wether in person or on paper being notarised with other partys witnessing it .

Now I know times have changed , things vary from county to county & state to state . But thats the only way I have ever done buisness & the proper way to hadle it . Its basiclly his word against hers if something were to happen . Unless theres a sighned & notarised piece of paper saying exactlly what the deal is .

Sorry Not trying to make something look worse then it is , But i,ve dealt with vehicles allmost my entire life as well as having a dealers licence . Might be different in sawyer county though .

Bottom line is if you would take the time to explain whats wrong with the whole picture , She might actually understyand better & thats the most important thing IMHO . Just my opinion . :wink:
 
I also forgot to mention , if He doesn,t transfer the title & register it through the state in his name . Your daughter will also be responsable for property taxes not having any proof its even been sold or changed hands .

Only exceptions at least around here is if she sold it to a dealer , Once again I,m just telling you what I know about how it works in Kansas , So i very well could be wrong about your situation . Just trying to help with the little bit I do know about things :wink:

I tried Bob.. She would not listen. During the sale I DID explain what I said above. She was defient - and pretty much was going to do what she wanted.. and my say was useless.

Only thing I know to do Tom is wait untill monday & call the local tag office & ask them , Laws may be different there , But I would find it hard to believe as the only person they care about or can trace it to is the last registered owner .

Cops have nothing to do with it unless theres a crime commited & sure shouldn,t be giving out info that they really dont even need to know , much less them actually knowing . Just my opinion though .

I like your thinking :clap: But I'd do that at the cost of my daughters relationship. She would NEVER forgive me. This is one of her "freinds" Anyone else - I'd do it! I'm really confused on the legallities on this so called "car sale"

As for Diana getting angry and storming off.. I doubt it was because she was against Dad, so much as it was the idea that she knows she messed up now.
 
I'm always a big fan of making the buyer sign a bill of sale and get a copy of their driver's license.
As far as what the law enforcement told you, if you didn't get it in writing, I wouldn't bet anything on it, especially if he didn't take time to research it. Check with a lawyer as they know the laws and how to bend them.

I think your daughter was trying to give someone a break and now she knows she messed up and is a little embarrassed. Take it easy on her and use it as a learning tool of what to do differently in similar situations. At least she would only be out a few hundred as opposed to thousands.
 
Tsaw, as far as your daughter is concerned, call it a learning experience that'll probably cost her a few hundred dollars. It could be worse. I think that when we were young we all got burned at some time or another by family or friends.

These days when I'm asked for a short term "loan" I ask for collateral. When they give me that pained look saying, "Don't you trust me, I'm your friend", I tell them that they are my friend right now and I trust them but once I loan them money, that becomes business and what do they have that I want that's worth that kind of money? Banks are in the business of lending money and I try real hard not to compete with them. I know that sounds pretty hard and cold but I've been burned too often in the past. It's a tough lesson to learn.

I hope that it works out for her and the result isn't too painful.

You do realize you need to talk to your daugther and apologize because I think you are more upset with the fella taking advantage of your good hearted daughter. And emphasize no matter how old she gets, you are always looking out for what is best for her!!!

Good luck Tom. Like others have said, this will be a learning experience for her. She still should be able to get the kid to sign an IOU and state on it how much will be paid and how often. If she can get this kind of stuff in writing she would have a good chance of recovering in small claims court if the kid doesn't pay the money back as he promised.
